Surcharging compliance — what you must know

Surcharging is legal but strictly regulated. Every requirement below must be met for a compliant program.

1. Maximum Surcharge Cap

The surcharge amount cannot exceed your actual cost of acceptance for that card type, and is capped at 3% of the transaction total — whichever is lower. You cannot profit from a surcharge; it is a cost-recovery mechanism only. Card networks audit for compliance and can penalize merchants who exceed the cap.

2. Debit Cards Are Never Surcharged

Federal law (Durbin Amendment, Dodd-Frank Act Section 920) prohibits surcharging debit card transactions — including debit cards presented and processed as credit. Prepaid cards are also excluded. Your payment terminal must be configured to detect debit cards and suppress the surcharge automatically. GoPayhawk ensures this is properly configured before go-live.

3. Card Network Registration Required

  • You must notify Visa and Mastercard in writing at least 30 days before you begin surcharging.
  • GoPayhawk submits this notification on your behalf as part of the program setup.
  • American Express and Discover have separate notification requirements — we handle these as well.
  • Failure to register before surcharging is a card brand violation and can result in fines or loss of processing privileges.

4. Mandatory Disclosure & Signage

  • At the store entrance: A notice must be posted informing customers that a surcharge applies to credit card transactions.
  • At the point of sale: A second notice at the register or checkout area, stating the surcharge amount or percentage.
  • On the receipt: The surcharge must appear as a separate, clearly labeled line item on the customer's receipt.
  • Online: For e-commerce, the surcharge must be disclosed on the checkout page before the customer confirms payment.

5. Uniform Application Across Card Brands

If you surcharge Visa credit cards, you must surcharge Mastercard, American Express, and Discover credit cards at the same rate. You cannot selectively surcharge only certain card brands. This rule is enforced by the card networks.

6. State Law Restrictions

Most states allow surcharging, but a small number have restrictions. Always confirm your state's current law before implementing a surcharge program.

Yes, surcharging is permitted for e-commerce transactions in states where it is allowed, subject to the same rules. The surcharge must be disclosed on the checkout page before the customer confirms their order. Your payment gateway must support surcharge logic — GoPayhawk will confirm compatibility with your existing setup.

Due to the 30-day card network notification requirement, setup takes a minimum of 30 days from the time your account is approved. GoPayhawk submits the notification on day one of your onboarding so the clock starts immediately. During that 30 days, we set up your terminal, provide signage, and train your staff so you're ready to go on day 31.
